This privacy policy (the “Privacy Policy”) describes how 4M Analytics (“4M”, “Company”, “we” or “us”) treats information that it collects or receives from you (“Users” or “you”) through the products and services provided to you by the Company (the “Products” and “Services”). 

Alongside the 4Map Terms of Use (the “4M Product ToU", or the “Terms”), this Privacy Policy governs your use of the Services. By clicking that you accept the terms and/or by accessing, using or subscribing to any of the Company’s Services, you agree to the Company's processing of Personal Information as described here. In case you are entering into this agreement on behalf of another legal entity, such other legal entity shall be considered as the User, and you represent that you have the power and authority to agree to this Privacy Policy on behalf of such entity. This Privacy Policy shall come to effect upon the earlier of the acceptance of the terms by the User or Users’ use of, or access to the Services.

Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms.

1. No Legal Obligation to Provide Information

For avoidance of doubt, you are not legally obligated to use any of the Services provided by the Company, or to disclose any information whatsoever to the Company in connection with such use. However, if you choose to use any of the Services, including without limitation use of the Services, Products, application or other services provided by the Company, in certain instances, provision of certain information (including as necessary for such purposes, Personal Information as defined hereunder) may be a pre-requisite for such use/receipt of the Services.

2. What Information We Collect about you?

We collect two types of data and information about our Users:

2.1.  The first type of information is non-identifiable and anonymous analytic and metric information (“Analytics Information”). We are not aware of the identity of the User from whom we have collected the Analytics Information. Analytics Information is any unconcealed information which does not enable identification of an individual User, and which is available to us while such User is entering into and/or using the Services. Analytics Information which is being collected consists of technical information, device information and general information pertaining to your activity information in our Services. This information includes: type and version of the device you use or from which you access to the Services, type and version of your operating system and carrier (where in mobile), type and version of your browser (via your user agent parameters), keyboard language, screen resolution, User’s clicks or searches on the Services and referral URL (i.e., the website from which you arrive to our Services).

2.2.  The second type of information is individually identifiable information (“Personal Information”). This information may identify an individual or may be of a private and/or sensitive nature. Users of the Services may automatically provide their IP address, such information is used mainly for enhancing the User’s experience and for geo-location and security purposes as further detailed below. Additionally, we collect your work email address, your name, and your log-in credentials for the purpose of providing you with access to our Services (by means of your account). Additional information may be requested from time to time upon the then-current need.

For avoidance of doubt, any Analytics Information connected or linked to any Personal Information is deemed as Personal Information as long as such connection or linkage exists or possible. It should also be clarified that a User is not legally obligated to use the Website, or to disclose any information whatsoever to 4M.

3. How Do We Collect Information?

3.1.  We collect information which is provided by you. We collect Personal Information directly from you when you contact us for support, or when you register your account. We may gather, collect and store the Personal Information either independently or through the help of our authorized third-party service providers, after we ensure that they meet industry security standards.

3.2.  Information we automatically collect. We may also automatically collect certain technical data that is sent to us from the computer, mobile device and/or browser through which you access the Service. This may include, without limitation, a unique identifier associated with your access device and/or browser (including, for example, your IP address).

3.3.  Information from other sources. We may also collect or receive Personal Information from third-party sources, such as your employer, third-party websites or integrations, our vendors and service providers, our business partners and sponsors, and other third parties.

4. For What Purposes do We Collect Information?

4.1.  Analytics Information is collected for the following purposes: we need such information to be able to tackle and resolve bugs, errors and other issues that may arise from time to time, and we want to better understand our visitors, so we can constantly improve our Services and make them relevant. We extract statistics and aggregations from the information, to allow better research over time, improve the quality of the Service by formulating, customizing and enhancing the experience and design of our Product.

4.2.  Personal Information is collected in order to: allow us to help you create an account and make use of our Services through such account, in order to provide you with customer support, and in order to communicate with you around your use of our Services, 4M may send you electronic communications to facilitate your support request or your general use of the Services, we may also use your business email in order to send you marketing communications.

5. Sharing Information with Third Parties

4M may share your Personal Information to fulfill the purpose for which you provide it, subject to applicable law, as follows:

5.1.  Agents, consultants, and service providers. We may share your Personal Information with our contractors and service providers who process Personal Information on behalf of us to help us provide you with the Services (in particular, we use HubSpot and Salesforce). When we engage such service providers to perform such functions, we may provide them with information, including Personal Information, in connection with their performance of such functions, if we do so, we will employ commercially reasonable efforts to protect your Personal Information, such as by reviewing their security measures and entering into data processing agreements with them.

5.2.  Legal requirements. To the extent necessary, with regulators, courts, banks or competent authorities, to comply with applicable laws, regulations and rules (including, without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by court order, as well as for internal compliance procedures and to protect the safety, security, and integrity of 4M, our Services, customers, employees, property, and the public. We may use or disclose the personal information we collect in order to ensure that our users are complying with all applicable aspects of our policies. We may disclose personal information with our lawyers, accountants, auditors and other professional advisors where necessary to obtain legal or other advice or otherwise protect and manage our business interests; we may use or disclose the personal information to investigate, prevent, or take action regarding illegal activities, suspected fraud, cybersecurity threats, situations involving potential threats to the physical safety of any person, violations of this policy, or as otherwise required or allowed by law and regulation. 

5.3. If, in the future, we sell or transfer, or we consider selling or transferring, some or all of our business, shares or assets to a third party, we will disclose your personal information to such third party (whether actual or potential) in connection with the foregoing events (including, without limitation, our current or potential investors). In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign your personal information in connection with the foregoing events.

5.4. With your consent. We may share your Personal Information with third parties when we have obtained your consent to do so.

5.5.  Aggregated or de-identified data. We may disclose aggregated or de-identified information for any purpose. Once Personal Information is in an aggregated form, for purposes of this Privacy Policy, it becomes Non-Personal Data.

6. Your Rights

6.1.  The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to individuals protected by specific laws): i. You have the right to withdraw consent to the processing, where consent is the basis of processing; ii. You have the right to request access to your personal information held by us, along with details on how it is processed, subject to certain conditions. You have the right to demand rectification of inaccurate personal information about you. We will promptly correct any information found to be incorrect; iii. You have the right to object to unlawful data processing under certain conditions; iv. You have the right to the erasure of past personal information about you under certain conditions.

6.2.  You can exercise your rights by contacting us at info@4m-a.com. You may use an authorized agent to submit a request on your behalf if you provide the authorized agent written permission signed by you. To protect your privacy, we may take steps to verify your identity before fulfilling your request. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly in accordance with applicable law or inform you if we require further information in order to fulfil your request. When processing your request, we may ask you for additional information to confirm or verify your identity and for security purposes, before processing and/or honoring your request. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. It may take up to forty-eight (48) hours for us to process your request.

7. Retention of the Personal Information

Please note that unless you instruct us otherwise, we may retain your Personal Information for as long as reasonably required for the purposes for which such Personal Information was collected, including without limitation, for future analytics and analysis, in order to comply with our legal or business requirements or obligations and to resolve disputes or to enforce our Terms, all as permitted under any applicable privacy laws. Aggregated and/or anonymous information derived from your use of the Services may remain on our servers indefinitely.

8. Security

We take reasonable measures to maintain the security and integrity of our Services and Personal information and prevent unauthorized access to it or use thereof through generally accepted industry standard technologies and internal procedures. We use reputable and high standard third party vendors and make sure to separate your sensitive data from another data about your use of the Services. Please note, however, that there are inherent risks in transmission of information over the Internet or other methods of electronic storage and we cannot guarantee that unauthorized access or use of your Personal Information will never occur. It is hereby clarified, 4M shall not be responsible or liable for unauthorized access, hacking, or other security intrusions or failure to store or the theft, deletion, corruption, destruction, damage, or loss of any data or information.

9. Third Party Service Providers

We may be using third party software or service in order to collect, host, store and/or process the information detailed herein. 4M uses commercially reasonable efforts to engage with third parties that post a privacy policy governing their collection, processing and use of non-personal and personal information. However, we do not control such third-party service providers, but we do oblige them to contractually commit to the highest standard of compliance with privacy protection and data security laws.

10. Links to Third Party Websites

Most of the third-party sites or other resources which are made available via our Services provide legal documents, including terms of use and privacy policy, governing the use thereof. It is always advisable to read third-parties' terms of use and privacy policy documents carefully before using those sites and services, as they shall govern any use of such third parties' websites, and inter alia, in order to know what kind of information they are collecting.

11. Cookies and Other Tracking Technologies

When you access the Application, we may use industry-wide technologies such as "cookies", “Pixels” or other similar technologies which store certain information on your device or your general use of the Services (“Cookies”). This allows us to enable automatic activation of certain features and make your experience much more convenient and effortless. 12. Cross-Border Information Transfer

We may transfer information collected about you, including Personal Information, to affiliated entities, or to other third-party service providers across borders and from your country or jurisdiction to other countries or jurisdictions around the world (all solely for legitimate business purposes such as internal systems tracking, provisioning, access control, reporting and activity logging), all such transfers being conducted in accordance with applicable law.

13. Changes to the Privacy Policy

The terms of this Privacy Policy will govern the use of the Service and any information collected therein. 4M reserves the right to change this Privacy Policy at any time, so please re-visit this page frequently.
